Gather to Create Policies and Procedures 

By booking or hosting a Gather to Create event, the individual completing the booking ("Host") represents that they are authorized to make arrangements on behalf of the business, organization, or entity hosting the event ("Organization") and agrees to the following terms and conditions.


Booking & Booking Fee

An event date and time are not considered reserved until Gather to Create has confirmed availability, the required booking information has been received, and the ( $100 - Personal or $500 - Corporate) non-refundable booking fee has been paid. The booking fee secures the agreed-upon event date and time and covers event planning, coordination, preparation, and travel to the event location. The booking fee is separate from per-participant workshop fees and is not applied as a credit toward participant fees unless expressly stated in writing by Gather to Create.No additional standard travel fee will be charged beyond the booking fee for events accepted and confirmed by Gather to Create. Any extraordinary travel requirements, including overnight accommodations or travel outside Gather to Create's normal service area, must be agreed upon in writing before booking.


Final Headcount & Payment

Personal Events -

Personal events require a minimum of 5 participants. The financial responsibility for collecting all fees is the responsibility of the host. The final participant count must be provided to Gather to Create no later than 7 calendar days before the scheduled event. All remaining event fees are due and will be collected in full 7 calendar days before the event. The final invoice will be based on the confirmed participant count or the 5-participant minimum, whichever is greater. Once the final headcount has been confirmed and payment has been collected, participant fees are non-refundable for individuals who cancel, do not attend, or choose not to participate because Gather to Create purchases and prepares materials based on the confirmed attendance. Requests to add participants after the 7-day deadline will be accommodated only when materials, staffing, and space allow. Additional participants must be paid for before the event unless otherwise agreed to in writing.

Corporate Events -

Corporate events require a minimum of 10 paid participants. The final participant count must be provided to Gather to Create no later than 14 calendar days before the scheduled event. All remaining event fees are due and will be collected in full 14 calendar days before the event. The final invoice will be based on the confirmed participant count or the 10-participant minimum, whichever is greater. Once the final headcount has been confirmed and payment has been collected, participant fees are non-refundable for individuals who cancel, do not attend, or choose not to participate because Gather to Create purchases and prepares materials based on the confirmed attendance. Requests to add participants after the 14-day deadline will be accommodated only when materials, staffing, and space allow. Additional participants must be paid for before the event unless otherwise agreed to in writing.


Cancellation & Rescheduling

The booking fee is non-refundable. If the Host cancels more than 14 calendar days before the event, any participant fees already paid beyond the booking fee will be refunded, unless Gather to Create has already purchased custom, personalized, specialty, or non-returnable materials specifically for the event. Costs associated with those materials may be deducted from the refund. If the Host cancels within 14 calendar days of the event, all amounts paid are non-refundable. Requests to reschedule are subject to Gather to Create's availability and are not guaranteed. Gather to Create will make reasonable efforts to accommodate one rescheduling request when sufficient notice is provided. Costs already incurred for custom, seasonal, personalized, or time-sensitive materials may remain the responsibility of the Organization. A rescheduled event must occur within a timeframe mutually agreed upon by Gather to Create and the Host.

Venue Rules & Permissions

The Host is responsible for obtaining all necessary approvals or permissions from the property owner, employer, building management, venue, or other applicable party. The Host must communicate applicable venue requirements to Gather to Create in advance, including security procedures, loading restrictions, parking requirements, vendor registration, insurance requirements, elevator access, building access, and restrictions on materials or activities.


Event Space & Setup

The Host is responsible for providing accurate information regarding the event location, anticipated number of participants, available space, and any site-specific restrictions or requirements. The Host must provide an appropriate space capable of safely and comfortably accommodating the confirmed number of participants and selected activity. This includes adequate tables, chairs, lighting, electrical access, water access, ventilation, or other reasonable accommodations communicated by Gather to Create. Gather to Create reserves the right to modify, delay, or decline to conduct an activity if the provided space is unsafe, unsuitable, materially different from the information provided during booking, or unable to reasonably accommodate the scheduled event. The Host must provide Gather to Create with reasonable access to the event space before and after the scheduled workshop for setup and breakdown. If delayed access, security procedures, unavailable facilities, incomplete setup, or other circumstances within the Host's or Organization's control delay the event, Gather to Create cannot guarantee that the workshop can be extended beyond its originally scheduled end time.


Protection of the Event Space

Creative experiences may involve paint, adhesives, glass, liquids, powders, dyes, markers, tools, or other materials that have the potential to spill, stain, scratch, adhere to, or otherwise affect surfaces or property. The Host or Organization are responsible for appropriately protecting tables, flooring, furniture, walls, equipment, and other property within the event space. While Gather to Create will use reasonable care when conducting the workshop, Gather to Create is not responsible for stains, spills, residue, scratches, cleaning expenses, or property damage resulting from ordinary participant activity, misuse of materials, failure to follow instructions, or inadequate protection of the venue.


Safe & Respectful Environment

The Host is responsible for providing a safe, respectful, and reasonably controlled environment for Gather to Create staff and participants.

Harassment, threatening behavior, intimidation, discrimination, unwanted physical contact, aggressive behavior, excessive disruption, or conduct that reasonably creates an unsafe or hostile environment will not be tolerated. Gather to Create reserves the right to pause or immediately end an event if conditions become unsafe, threatening, excessively disruptive, or inappropriate. If an event is ended because of Host or participant conduct, amounts paid will not be refunded.


Animals

Animals may not be present in the workshop area during setup, the event, or breakdown.

Any pets or other animals at the property must be securely contained in a separate area that Gather to Create staff will not need to access.

Service animals required because of a disability are permitted in accordance with applicable law.


Alcohol & Participant Conduct

If alcohol is provided or permitted at an event, the Host and Organization are solely responsible for its purchase, service, possession, consumption, and compliance with applicable laws, venue requirements, and organizational policies. Gather to Create does not sell, provide, serve, supervise, or monitor alcohol. Gather to Create reserves the right to prevent any individual who appears impaired from using tools, heat sources, glass, chemicals, sharp objects, or other materials when participation could reasonably create a safety risk.
 

Allergies, Sensitivities & Participant Accommodations

The Host is responsible for notifying Gather to Create before the event of any known allergies, sensitivities, accessibility needs, or other participant considerations that may reasonably affect participation in the selected experience. Workshop materials may include or come into contact with substances that can cause allergic reactions or sensitivities, including fragrances, essential oils, adhesives, paints, dyes, natural materials, food ingredients, latex, metals, plants, or other substances depending upon the selected activity.Gather to Create will make reasonable efforts to provide ingredient or material information upon request but cannot guarantee that materials or environments will be completely free from allergens, cross-contact, fragrances, or other potential irritants. Participants are responsible for determining whether participation is appropriate based on their individual allergies and sensitivities.


Photography & Promotional Use

Gather to Create may photograph or record portions of an event, including completed projects, event setups, workshop materials, and participants, for use in Gather to Create's website, portfolio, advertising, marketing materials, and social media. The Organization may request in writing before the event that participants not be photographed or that event photography not be used publicly. Gather to Create will honor confirmed photography restrictions communicated before the event. When the Organization permits photography, the Host is responsible for communicating applicable organizational photography policies or restrictions to Gather to Create before the event. Gather to Create will not intentionally identify individual participants by full name, employer-specific confidential information, or other personal information without appropriate permission.


Intellectual Property & Project Designs

Workshop concepts, project designs, instructional materials, templates, patterns, graphics, demonstrations, written instructions, photographs created by Gather to Create, and other original Gather to Create materials are owned by Gather to Create or used with appropriate permission.

Participation in an event does not transfer ownership of Gather to Create's intellectual property to the Host, Organization, or participants.

Gather to Create materials may not be reproduced, resold, distributed, commercially used, taught to others for compensation, or used to create competing workshops without prior written permission from Gather to Create.

Participants retain ownership of the physical projects they create during the workshop.


Force Majeure

Neither Gather to Create nor the Organization will be considered in breach of its obligations when an event cannot reasonably proceed because of circumstances beyond the affected party's reasonable control, including severe weather, natural disasters, fire, government restrictions, public emergencies, utility failures, transportation disruptions, widespread illness, acts of God, or other extraordinary circumstances.

When such circumstances occur, Gather to Create will make reasonable efforts to reschedule the event to a mutually agreeable date.

Amounts already spent on custom, personalized, perishable, seasonal, or non-refundable materials may not be refundable. Any remaining amounts will be handled reasonably based on the circumstances and costs already incurred.


Assumption of Risk

Hands-on creative activities involve ordinary and foreseeable risks associated with tools, materials, equipment, and participant activity.

By participating, attendees agree to follow instructions provided by Gather to Create and exercise reasonable care. To the fullest extent permitted by applicable law, Gather to Create is not responsible for injuries, losses, or property damage resulting from a participant's failure to follow instructions, misuse of materials or equipment, unsafe conduct, intoxication, undisclosed allergies or sensitivities, or conditions of the Host's premises outside Gather to Create's reasonable control. Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.


Indemnification

To the fullest extent permitted by applicable law, the Organization agrees to indemnify, defend, and hold harmless Gather to Create LLC and its owners, employees, contractors, and representatives from third-party claims, damages, losses, liabilities, and reasonable costs arising from:

  • Unsafe or defective conditions at the Organization's event location;

  • The conduct, negligence, or misconduct of the Organization, Host, participants, employees, guests, or invitees;

  • The Organization's failure to obtain necessary venue approvals or permissions;

  • The Organization's violation of applicable laws or venue requirements;

  • Alcohol provided, served, or permitted by the Organization or its vendors; or

  • Material information or restrictions the Organization failed to disclose to Gather to Create before the event.

This provision does not require the Organization to indemnify Gather to Create for claims caused by Gather to Create's own negligence or willful misconduct to the extent such indemnification is prohibited by applicable law.


Personal Property

Gather to Create is not responsible for lost, stolen, misplaced, or damaged personal belongings belonging to participants, employees, guests, or the Organization.


Right to Refuse or Discontinue Service

Gather to Create reserves the right to refuse, pause, modify, or discontinue an event when reasonably necessary because of unsafe conditions, harassment, threatening or disruptive behavior, intoxication, undisclosed venue restrictions, inadequate space, prohibited animals in the workshop area, or other circumstances that could reasonably place Gather to Create staff, participants, or property at risk. If services cannot be completed because of circumstances within the Host's or Organization's reasonable control, payments are non-refundable.


Acceptance of Terms

By submitting a booking request, paying the booking fee, paying an invoice, electronically accepting these Terms, or otherwise confirming an event, the Host acknowledges that they have reviewed and agree to these Corporate Event Terms & Conditions and represents that they have authority to enter into the event arrangement on behalf of the Organization. These Terms, together with the applicable proposal, invoice, booking confirmation, and any written event-specific terms provided by Gather to Create, constitute the agreement governing the corporate event.
